Family Reunification in Spain: Security for Your Family

General Regime vs. Community Regime

It is essential to correctly identify the legal framework applicable to your family situation.

General Regime

For Non-EU Residents

Applicable to foreigners with legal residence in Spain who wish to bring their family members. Requires having resided for at least 1 year (to reunify spouse and children) or being a long-term resident (for ascendants).

  • Family bond: Spouse, children under 18, and ascendants over 65.
  • Initial application in Spain by the reunifying party.

Community Regime

Relatives of EU Citizens / Family Roots

For relatives of Spanish citizens or other EU States. Includes the EU Family Member Card and the new Family Roots for caregivers or children of Spanish nationals by origin.

  • Relatives: Spouse, registered partner, children under 21, and dependent ascendants.
  • Direct processing in Spain after the relative's entry.

Real Limits: Income and Housing

The administration applies strict mathematical criteria. The desire to be together is not enough; material capacity for support must be demonstrated.

Economic Income (IPREM)

General Regime: 150% of IPREM for the first relative (approx. €900) and 50% extra for each additional relative.

Housing Adequacy

It is mandatory to present an Adequate Housing Report issued by the Autonomous Community or City Council.

Economic Dependency

For ascendants, it must be proven that they live at the expense of the reunifying party through regular money transfers (generally last 12 months).

Critical Documentation

Family Bond

Marriage or birth certificates duly apostilled or legalized and translated.

Means of Support

Employment contract, pay stubs, and last Income Tax return (IRPF).

Health Insurance

In the community regime, it is vital to have private insurance without waiting periods or copays if not working.

Important Note: Resolution deadlines vary according to the Immigration Office, but administrative silence is usually negative after 45-90 days. A perfect presentation reduces the risk of requirements that prolong the process.
